The provided collectibles “BoomerPunks” are digital artworks, known as Non-Fungible Tokens (NFTs), running on the Tezos network.
nft.agentur-boomer.de (this website) is only an interface allowing participants to collect these digital artworks. Users are responsible for the safety and management of their own private Tezos wallets and validating all transactions and contracts generated by this website. As the BoomerPunks smart contract runs on the Tezos network, there is no ability to undo, reverse, or restore any transactions and brandneo GmbH ist not responsible for any actions done by a user or a third party.
This website and its services are provided “as is” and “as available” without warranty of any kind. By using this website you are accepting sole responsibility for any and all transactions. There is no guarantee of getting a collectible because they are limited.
The use of the Tezos network and a wallet require knowledge about the use of the blockchain and may be associated with prior costs. Find out in advance how you can use the Tezos network.
Ownership
1. You Own the NFT
Each BoomerPunk is an NFT on the tezos blockchain. When you purchase an NFT, you own the underlying BoomerPunk, the Art, completely. Ownership of the NFT is mediated entirely by the Smart Contract and the Tezos Network: at no point may we seize, freeze, or otherwise modify the ownership of any BoomerPunk.
2. Personal Use
Subject to your continued compliance with these Terms, brandneo GmbH grants you a worldwide, royalty-free license to use, copy, and display the purchased Art, along with any extensions that you choose to create or use, solely for the following purposes: (1) for your own personal, non-commercial use; (2) as part of a marketplace that permits the purchase and sale of your BoomerPunk / NFT, provided that the marketplace cryptographically verifies each BoomerPunk owner’s rights to display the Art for their BoomerPunk to ensure that only the actual owner can display the Art; or (3) as part of a third party website or application that permits the inclusion, involvement, or participation of your BoomerPunk, provided that the website/application cryptographically verifies each BoomerPunk owner’s rights to display the Art for their BoomerPunk to ensure that only the actual owner can display the Art, and provided that the Art is no longer visible once the owner of the BoomerPunk leaves the website/application.
3. Commercial Use
Provided you comply with these terms, brandneo GmbH grants you an unlimited, worldwide license to use, reproduce and display the purchased artwork for the purpose of creating derivative works based on that artwork.
Examples of such Commercial Use would e.g. be the use of the Art to produce and sell merchandise products (T-Shirts etc.) displaying copies of the Art.
Note that other terms (and Logos) such as “Agentur Boomer“, but also terms such as “Marketing-Melanie“ and others are probably protected by trademark law. Commercial use therefore refers exclusively to the artwork. The trademark application by third parties is definitely excluded.
